Welcome to The Process website (the “Site”). These Terms of Use (“Terms”) are a binding agreement between you and The Process Beauty Solutions (Pty) Ltd (“The Process,” “we,” “us,” or “our”). By accessing or using our Site and services, you agree to abide by these Terms and all related policies referenced here. If you do not agree, please refrain from using our Site.

1. Age & Eligibility

You must be 18 or older to purchase products or create an account on our Site. By using the Site, you confirm that you meet this age requirement and are legally able to enter a contract. If you are under 18, you may browse the Site with the consent and supervision of a parent or guardian, but please do not provide personal information or make purchases. We reserve the right to refuse service, cancel orders, or terminate accounts if we suspect that a user is underage or otherwise violating these Terms.

2. Account Registration & Security

Creating an account is optional but recommended (it unlocks our loyalty program and faster checkout). If you register, you agree to provide accurate, current information and keep it updated. Keep your login credentials confidential. You are responsible for any activity under your account. If you suspect unauthorized use of your account, notify us immediately at support@theprocess.co.za. We are not liable for losses due to compromised passwords (so choose a strong one!). We may suspend or terminate accounts for security reasons or if these Terms are violated.

Pro tip: Use a unique password for our Site and sign out after use on shared devices – basic internet hygiene!

3. Your Privacy

Your privacy is extremely important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms. By using the Site, you consent to our collection and use of information as described therein. In short, we collect necessary info to process orders and improve your experience, and we do not sell your data to third parties. Please review the Privacy Policy for details on what data we collect, how we use it, and your rights regarding your information.

4. Loyalty & Rewards Program

If you create an account, you’re automatically enrolled in our Your Care Circle loyalty program. Points, rewards, and program rules are detailed on our Loyalty Program page. Points have no cash value, are not transferable, and are subject to the program’s terms. We reserve the right to modify or discontinue the loyalty program (or specific rewards) at any time, though we’ll notify members of any significant changes and honour points already earned. Abuse of the program (e.g., exploiting loopholes, fake referrals) may result in point forfeiture or account termination, per our discretion.

5. Purchases & Orders

When you place an order, you’re making an offer to buy the product(s) in your cart. We will send an order confirmation email, but that is not final acceptance of your order – actual acceptance occurs when we ship the product, at which point a purchase contract is formed. We reserve the right to refuse or cancel orders for any legitimate reason, including inaccuracies, suspected fraud, or supply issues. If an order is cancelled after payment, we’ll issue a full refund.

Pricing: Prices are listed in South African Rand (ZAR) by default, inclusive of VAT (if applicable) unless stated otherwise. We strive to ensure all pricing, fees, and product information on our Site are accurate, but errors may occur. If we discover a pricing error in your order, we will inform you and give you the option to reconfirm at the correct price or cancel for a full refund. Prices and promotions are subject to change without notice, but changes will not affect orders already placed.

Payment: We accept major credit/debit cards and other payment methods as indicated at checkout. By entering payment details, you confirm you’re authorized to use that method and you authorize us (or our payment processor) to charge the full order amount (including any applicable taxes and shipping). Payment must clear before we dispatch products. We use secure third-party payment processors; your card details are not stored on our servers (for subscription convenience, our payment partner may securely tokenise your card info). If a payment is declined or fails, we cannot process your order; please ensure billing details are correct and sufficient funds available.

Shipping: We currently ship within South Africa (and select regions as updated on our Shipping Policy). We will make reasonable efforts to deliver orders within the estimated timeframe, but delays can happen. We are not liable for shipping delays beyond our control (e.g., courier issues or customs). Title and risk of loss for products pass to you upon delivery. Please see our Shipping Policy page for more details on methods, costs, and timelines.

Returns: We want you to love The Process, but if you need to return or exchange, our policy allows it within 14 days. Products should be in new or gently used condition. For detailed instructions, see our Return Policy page. Refunds are made to the original payment method. Note that original shipping fees are non-refundable (unless the return is due to our error or a defective product). We may deny a return or issue partial refunds in cases of excessive wear or missing components. We reserve the right to limit or refuse returns from customers who show signs of “serial returning” abuse.

6. Product Information & Disclaimer

We strive to ensure that all product descriptions, ingredients, and photos on our Site are accurate and up-to-date. However, there may occasionally be errors, omissions, or slight variations (especially as we continuously improve our formulas or packaging). Colors on screen may appear differently than in person due to monitor settings. If a product you receive isn’t as described, you may return it in unused condition for a refund or exchange.

All products and content on our Site are for general skincare purposes. They are not intended to diagnose, treat, cure, or prevent any disease. While we share tips and customer experiences, these are not medical advice. Individual results can and will vary – we do not guarantee specific outcomes for everyone, as skin is wonderfully unique. If you have serious skin conditions or medical concerns, please consult a dermatologist or healthcare professional.

Patch testing is recommended, especially if you have sensitive skin or known allergies – apply a small amount of a new product on your inner arm and wait 24 hours. If irritation occurs, discontinue use. Should you experience any adverse reaction, seek medical attention if needed and inform us as well (we keep a close eye on product feedback).

Content Accuracy: Any skincare advice, articles, or blog content we provide is for educational purposes. We try to ensure accuracy and usefulness, but it may not be tailored to your personal situation. Use your own discretion or consult a professional for personal advice. The Process isn’t liable for how you apply information from our content – but we do mean well with everything we share!

7. Intellectual Property

All content on the Site – including text, graphics, logos, images, videos, and software – is the property of The Process or our content suppliers and is protected by copyright, trademark, and other intellectual property laws. The Process™ and associated logos and taglines (like “Everything you need, nothing you don’t, Minim’holistic”) are our trademarks/service marks. You are granted a limited license to access and use the Site for personal, non-commercial purposes. Without our express written consent, you may not:

  • Reproduce, duplicate, copy, or resell any part of the Site or content.
  • Use our name, trademarks, or branding in a way that confuses others or disparages us.
  • Use data mining, robots, or similar data-gathering tools to extract content.

If you want to share something from our site – like a blog post or an image – please credit us appropriately and don’t alter it in a misleading way. For press or commercial partnerships, reach out to us for proper permissions. We love collaboration, but we also need to protect our brand’s hard work.

8. User-Generated Content & Community Guidelines

Our Site may allow you to post reviews, comments, or upload content (collectively “User Content”). By submitting any User Content, you give The Process a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, and display that content on our website or social channels. This helps us showcase testimonials or answer questions publicly. You retain ownership of your content and can request its removal by contacting us, and we’ll do our best to accommodate.

When engaging on our Site or social media, you agree to be respectful and lawful. That means: no harassment, hate speech, obscene or offensive material, no incitement, no violating others’ rights (like posting someone else’s photo without permission). Keep it friendly and on-topic. We moderate content and reserve the right to remove or not publish anything that violates these guidelines or is deemed inappropriate for our community. That said, we welcome honest reviews – even if critical – as long as they’re constructive and genuine. Don’t spam, advertise unrelated products, or post false information. If you’re found to be repeatedly violating these rules, we may restrict your ability to post or even ban your account, in line with these Terms.

By posting a review or comment, you also affirm that it’s your original content, and you’re not impersonating someone else or being paid by a competitor to leave negative feedback (sadly, it happens in the industry). Let’s keep it real and helpful for everyone.

9. Gifting & Communications

If you purchase a product as a gift and provide recipient information (like email or address), you are responsible for ensuring you have the recipient’s consent to share their details with us. We will use that info only for fulfilling the gift (e.g., shipping, and a courtesy email to the recipient if you opted for that). We won’t add gift recipients to marketing lists unless they independently subscribe later. Please use our gift message feature kindly – any message you submit for the gift note must adhere to the same respectfulness as other user content. No offensive or harmful messages; we reserve the right to not transmit any gift message that violates our guidelines (and we will notify you if so).

When you use our Site or send emails to us, you’re communicating electronically. You consent to receive communications from us electronically as well (e.g., via email or site notifications). This includes order confirmations, shipping notices, password reset emails, newsletters if you subscribed, and support responses. You can keep records of these communications for your reference. For marketing emails, you can opt out anytime by clicking “unsubscribe” in the footer of those emails. But transactional emails (order updates, etc.) are necessary for us to fulfil our contract with you.

10. Site Availability & Changes

We aim to have our Site up 24/7, but we cannot guarantee uninterrupted service. Maintenance, updates, or technical issues may occasionally make the site unavailable. We’ll try to schedule any planned downtime during off-peak hours and post a notice if possible. The Process is not liable for any losses if our site is temporarily down or if certain features aren’t working perfectly at any given moment.

We reserve the right to modify or discontinue any part of our Site, products, or services at any time. We might add or remove features, adjust the look and feel, or update content. Significant changes (like a major overhaul of these Terms or pricing model) will be communicated to users in advance via the site or email. Your continued use of the Site after changes indicates acceptance of those changes. If you don’t agree with updates, you should stop using the Site and can contact us with any concerns.

11. Disclaimer of Warranties

The Site and all products and content provided through it are offered “AS IS” and “AS AVAILABLE.” The Process makes no representations or warranties of any kind, express or implied, about the operation of the Site or the information, content, materials, or products included. To the fullest extent permissible by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.

While we hope our products delight you, we do not guarantee that your specific results will meet your expectations or that the Site will meet all your needs without error or interruption. We do not warrant that any errors on the Site (technical or content-wise) will be corrected immediately, though we sure try.

Any reliance you place on information from our Site is at your own discretion and risk. We encourage you to do what’s right for you and seek professional advice where appropriate.

(Some jurisdictions don’t allow the exclusion of certain warranties, so portions of this section may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.)

12. Limitation of Liability

To the maximum extent permitted by applicable law, The Process and its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or our products. This includes, without limitation, damages for loss of profits, loss of data, business interruption, or similar economic losses, even if we have been advised of the possibility of such damages.

For example, we will not be responsible for loss of business revenue due to temporary Site unavailability, or for adverse reactions resulting from unknown individual sensitivities. We strongly recommend patch testing prior to full use of any product.

Nothing in these Terms limits or excludes liability for gross negligence, willful misconduct, or any liability that cannot be excluded or limited under applicable law, including mandatory consumer guarantees and liability for personal injury or damage caused by a defective product where required by law.

Your statutory rights remain unaffected. Any warranties or guarantees implied by law that cannot be excluded are limited to the maximum extent permitted by law, including in duration and scope.

13. Indemnification

You agree to indemnify and hold harmless The Process and its affiliates, officers, directors, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party arising out of (a) your breach of these Terms or any policy incorporated, (b) your violation of any law or rights of a third party, or (c) any content you posted on our Site. This means if your actions (or content) cause us to be sued or fined by someone else, you’ll cover those costs.

For example, if you post a product review that infringes someone’s copyright and they sue us, we’d expect you to step in and handle it (or reimburse us) because it was your action. Or if you misuse the Site in a fraudulent manner and it causes damage, you’d be responsible.

We’ll do our best to mitigate any issues and will notify you promptly of any such claims. You agree to cooperate with us as needed to defend such claims. We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, but we’ll likely work together for the best outcome.

14. Governing Law & Dispute Resolution

These Terms and any disputes arising from your use of the Site or purchase of products are governed by the laws of South Africa, without regard to its conflict of law principles. You agree that any dispute or claim arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa, specifically the courts located in Cape Town, Western Cape, unless we mutually agree on an alternative.

However, we truly hope to never see each other in court! If you have an issue, please reach out to us first. We commit to trying our best to resolve any concerns in good faith. Perhaps through friendly negotiation or mediation. We may even suggest an independent arbitration if it makes sense and both parties agree, as an alternative to litigation, especially for smaller claims – but it’s not mandatory unless required by law.

For EU/UK customers (if any): While our focus is SA, if by chance you’re an international customer, you may have rights to certain dispute resolution avenues (like the EU Online Dispute Resolution platform). But again, talk to us – we want to fix things amicably.

15. Changes to Terms

We may revise these Terms from time to time, for example to reflect changes in laws, our practices, or new features on the Site. The latest version will always be posted on the Site (check the “Last updated” date at the top). If we make material changes that affect your rights or obligations, we’ll take reasonable steps to notify you – likely via email and/or a prominent notice on our Site. It’s important you keep your account email current and check these Terms periodically.

Your continued use of the Site after updated Terms are posted (and effective) signifies your agreement to the changes. If you don’t agree, you must stop using the Site and can close your account (we’ll miss you, but we understand).

16. Miscellaneous

Entire Agreement: These Terms (along with our Privacy Policy and any other policies or guidelines we link to) constitute the entire agreement between you and The Process regarding your use of the Site, and supersede any prior agreements (oral or written) about the same subject. Any ambiguity in interpreting these Terms shall not be construed against the drafting party (that’s us) just because we wrote them.

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of the remaining provisions. We’ll try to replace any invalid term with one that matches the intent as closely as possible.

No Waiver: If we don’t enforce a provision of these Terms, that doesn’t mean we’re waiving our right to do so later. For example, if you breach these Terms and we don’t immediately take action, we’re not giving up any rights – we’re likely just being considerate or taking time to evaluate. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of The Process.

Transfer: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We can assign these Terms or delegate obligations at our discretion (for instance, if there’s a corporate reorganization, or to a new owner if the company is acquired), but we’ll ensure the Terms remain equally binding and protective of your rights.

Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect. They’re just there to make it easier to read (we know legal docs can be a slog).
